These terms apply to the use of CiphersCity, provided by L. Genzel in Zwolle (Dutch CoC no. 08214517). By using CiphersCity you agree to these terms and to our privacy statement. Please read them carefully before you start a tour.

The service

CiphersCity offers puzzle tours and city walks with stories at real places in the city. During the launch all tours are free to play; we may offer paid tours in the future. For each route you can see whether it is fact-checked and whether it has been walked by the makers themselves. The information, stories and navigation are an aid and entertainment, not an exact or official guide. You decide for yourself whether to walk a tour and whether it is suitable for you and your group.

How routes are created (AI)

Our routes are created with the help of AI and carefully checked. Even so, information may be incorrect, incomplete or out of date: places, buildings, opening hours and surroundings change. We do not guarantee the accuracy, completeness or timeliness of the content, and you use it at your own risk. If you spot something that is wrong, report it in the app and we will fix it where possible. To the extent permitted by law, we are not liable for incorrect or incomplete information in a route.

Safety and your own responsibility along the way

You walk a route entirely at your own responsibility and at your own risk. You are in public space and remain responsible for your own safety and that of your group. Always pay attention to traffic, water and height differences and your surroundings, follow the traffic rules and any on-site instructions, and do not stare at your screen while walking or crossing. Do not enter private property and follow the rules of the places you visit. Assess for yourself whether a route, place or time is safe and suitable, taking into account the weather and your own fitness. CiphersCity is expressly not navigation in traffic and not a safety instruction.

Children and supervision

CiphersCity is suitable for all ages, but children play under the responsibility and supervision of an adult. That adult supervises and assesses whether a route and its surroundings are suitable and safe for the child. We do not supervise participants ourselves.

Your conduct and contributions

Do not use the app for unlawful purposes, and treat other people, their property and the places and monuments you visit with respect. You are responsible for what you upload or write (photos, reviews, reports). Only upload material you have the rights to and that does not show recognisable people without their consent, and do not put unlawful, offensive or misleading content in reviews or reports. By sharing material you give us the right to show it (after review) within the service. You indemnify us against third-party claims arising from what you share. We may remove inappropriate content and block abuse.

Payments and donations

During the launch the tours are free. At the end of a tour you can make a voluntary donation; this is not required and not a condition for playing. A donation is voluntary and is not refunded, except where the law requires it. Donations and any future payments run through our payment provider Stripe. If we offer paid tours or rewards in the future, we will show their conditions and your statutory rights (including any right of withdrawal) with the relevant route.

Availability of the service

We do our best to keep the app available and working, but we do not guarantee uninterrupted or error-free availability. The app depends on your device, your internet connection, your GPS signal and third-party services (such as maps and routing). We may change, temporarily suspend or discontinue the service or parts of it. To the extent permitted by law, we are not liable for unavailability or malfunctions.

Liability

To the extent permitted by law, L. Genzel and the makers are not liable for damage, injury or loss arising from or connected with the use of the app or the walking of a route, including damage from incorrect or incomplete information, unavailability or malfunctions of the service, the acts of third parties, or decisions you make along the way. This exclusion does not apply in the event of intent or deliberate recklessness on our part. If, despite the above, liability nevertheless exists, it is limited to no more than the amount you paid for the relevant tour. Nothing in these terms excludes or limits liability to the extent that this is not permitted under mandatory law, including mandatory consumer law.

Intellectual property

The content of the routes, texts, images and design belong to L. Genzel or the rights holders. You may not reproduce, copy or use them commercially without permission.

Termination and changes

We may change or discontinue the service or a route. We may change these terms; the most recent version is on this page and in the app.

Governing law

These terms are governed by Dutch law, and disputes are submitted to the competent court in Overijssel, to the extent permitted by law. If you play as a consumer from another country, you also retain the mandatory protection of the law of your country of residence.
